Zacky Farms' equipment, intellectual property to be auctioned

Following the recent announcement that Zacky & Sons Poultry LLC, operating as Zacky Farms, will cease operations in January 2019, one of its lenders, GemCap Lending I LLC, announced that it will hold a secured party public sale at 9:00 a.m. (Pacific Standard Time) Nov. 15 by telephone, pursuant to Section 9-610 of the Uniform Commercial Code.

GemCap Lending said it has a first priority perfected lien and security interest in all of the personal property assets of Zacky & Sons Poultry, a California limited liability company. According to the announcement, GemCap Lending's collateral subject to the public sale will be limited to:

1. Certain machinery and equipment owned by Zacky, including, without limitation, all furniture, trade fixtures, computer equipment, telephone equipment, molds, tools, dies, partitions, tooling, transportation equipment, rolling stock and all other tangible assets used in connection with the manufacture, sale or lease of goods or rendition of services, all as set forth on the schedule prepared by the secured party;

2. The following trademarks and tradenames: ZACKY FARMS; ZACKY FARMS (STYLIZED); THE CALIFORNIAN; TENDER GOLD; SAMUEL'S RANCH; INTERNATIONAL POULTRY; LILLIANZ RANCH; THE WESTERNER; QUICK'N LEAN; TENDER GOLD; POPPY; SOUP'R CHICKEN; CULINARY CLASSICS; INTERNATIONAL POULTRY, and ZACKY;

3. The following domain names: www.zacky.com and www.zackyfarms.com, and

4. Borrowers' customer lists.
