Administration drops fight over lesser prairie chicken

Concerns still exist that FWS could drop court challenge but then try to relist bird despite improved population numbers.

The Obama Administration has decided to abandon its efforts to list the lesser prairie chicken (LPC) as a threatened species under the Endangered Species Act (ESA) by dropping its appeal of a Texas federal court's ruling that vacated the listing.

This decision comes after U.S. district Judge Robert A. Junell of Midland, Texas, overturned the listing of the LPC as a threatened species on Sept. 3, 2015. The bird was listed as threatened in 2014 by the U.S. Fish & Wildlife Servic
