California WOTUS violation case seeks DOJ intervention

Attorney General Sessions asked to intervene in WOTUS violation case involving John Duarte who faces violations for plowing his wheat field.

John Duarte, a fourth-generation California farmer, is in a legal battle with federal regulators over whether he violated federal law by plowing his land.  

There are some spots in his field where water stands after a rain. He often doesn’t plow or plant in those areas, even though they are dry most of the time. However, in 2012, he did plow one of these spots about 7 in. deep to plant wheat.
